This indenture made the twenty eighth day of August A.D. One thousand eight
hundred and fifty five between Charles Covillaud, Jose Manuel Ramirez, William
H. Sampson, Charles B. Sampson, Gabriel N. Swezy and Schuyler C. Tompkins as
administrator of the estate of Robert B. Buchanan deceased all of the City of
Marysville County of Yuba and State of California parties of the first part and
the Marysville Hebrew Benovolent Society of the same City, County and State
aforesaid, party of the second part Witnesseth that the said parties of the
first part for and in consideration of the sum of Fifty Dollars lawful money of
the United States of America to them in hand paid by the said party of the
second part at or before the unsealing and delivery of these presents have
bargained granted sold aliened remised released conveyed and conveyed and
confirmed and by these presents do grant bargain all alien remise release convey
and convey and confirm unto the said party of the second part forever all that
piece or parcel of land situated in the City of Marysville County of Yuba and
State of California and bounded as follows to wit: Commencing at the south east
Corner of the present City Cemetery thence easterly N 84° ˝ E. one hundred and
eighty feet to the west line of A Street for a line extended with the west line
of said Street Thence northerly along the west line of said Street two hundred
and forty two feet to a post thence South 84° ˝ W.

one hundred and eighty feet to a post on the East line of the City Cemetery
thence S. 5 ˝° E. two hundred and forty two (242) feet to the place of
beginning. Containing one acre more To have and to hold the same with all the
rights privileges and appurtenances thereunto belonging or in any wise
appertaining unto the said party of the second part. The said parties of the
first part hereby covenanting that they will warrant and defend the title to the
said promises and even part thereof every person or persons whomsoever claiming
or to claim the same or any part thereof. In witness whereas the parties of the
first part have hereunto let their hand and seals the day and year first above

N. Swezy S. S. Signed sealed and delivered in presence of E. Dupre State of
California County of Yuba II On this thirteth day of August A.D. One thousand
eight hundred and fifty five, personally came before me Eugene Dupre a Notary
Public in and for Yuba County aforesaid Charles Covillaud, Jose M. Ramirez, Wm.
H. Sampson, Ch B. Sampson, Gabriel N. Swezy, known to me to be the persons
described in and who executed the foregoing instrument of writing and also came
Schuyler C. Tompkins known to me to be the executor of the last will and
testament of R. B. Buchanan mentioned in the said instrument and the said S. C
Tompkins acknowledged before me that he executed the same as such executor as
aforesaid and the said Charles Covillaud Jose M. Ramirez Wm. H. Sampson C. B.
Sampson and G. N. Swezy severally acknowledged to me that they executed this
instrument freely and voluntarily and for the uses and purposes therein
mentioned. In witness whereof I have hereunto Let my hand and affixed my seal of
